These Terms of Service (the “Terms”) are a binding agreement between you and Lunarie, Inc. (“Lunarie,” “we,” “us,” or “our”) and govern your access to and use of www.lunariehome.com (the “Site”) and your purchase of our products. By checking the box indicating that you agree to these Terms at checkout, by creating an account, or by purchasing from or otherwise using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.
The Site is operated by Lunarie, Inc. and is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell to you. These Terms apply to all users of the Site, including browsers and customers.
You represent that you are at least the age of majority in your state of residence and are able to form a binding contract. The Site is intended for adults and is not directed to children under 13, and we do not knowingly collect personal information from children under 13.
Each Lunarie piece is handcrafted in small batches. Variations in color, tone, texture, surface detail, air pockets, and edges are inherent to the material and are not defects, Sizing may vary. Because pigments are used and screens differ, the colors you see may not exactly match the product. Product photos are for reference only and exact replication is not guaranteed. Lifestyle images may include digitally enhanced or AI-generated environments for styling inspiration only.
Please refer to our Material Characteristics Link ,page prior to placing an order with us, to make sure you are comfortable with the variety of different characteristics that may occur in our concrete blends.
Please be aware of possible slight variations between online representation and the actual product, due to color differences on various monitors and devices, and the handcrafted nature of our products.
All prices are shown in U.S. dollars and exclude shipping and taxes, which are calculated and displayed at checkout. Prices and product descriptions may change prospectively at any time, but a change will not affect an order we have already accepted, and you have paid for. Your order is an offer to buy; we accept it when we send an order-confirmation or shipping email. We may, in our reasonable discretion, limit or refuse an order, including orders that appear to be placed by resellers or that exceed quantity limits. If we cancel an order you have paid for, we will refund you in full.
Shipping, delivery timeframes, risk of loss, and handling of items damaged in transit are governed by our Shipping Policy link, which is incorporated by reference.
Cancellations, returns, exchanges, restocking fees, and refunds are governed by our Return & Refund Policy link, which is incorporated by reference.

We grant you a limited, personal, non-transferable license to access and use the Site for shopping. You may not copy, reproduce, scrape, resell, or exploit any part of the Site or its content without our prior written permission. All Rights Reserved .
If you send us ideas, suggestions, reviews, photos, or other materials (“Submissions”), you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and publish them in any medium, and you represent that the Submission is yours to share and is lawful, non-infringing, and not misleading. We are not obligated to keep Submissions confidential, to compensate you, or to respond, and we may (but need not) remove content we consider objectionable or unlawful.
You may not use the Site or its content: for any unlawful purpose; to violate any law or the rights of others; to infringe intellectual property; to harass, abuse, or discriminate; to submit false information; to upload viruses or malicious code; to collect others’ information; to spam, phish, scrape, or crawl; or to interfere with or circumvent the Site’s security. We may terminate your use for any prohibited use.

Except as expressly stated by us in writing and to the maximum extent permitted by applicable law , the site and all products are provided “as is” and “as available” without warranties of any kind , express or implied , including the implied warranties of merchantability, fitness for particular purpose, title and non- infringement. We do not warrant that the site will be uninterrupted, secure or error-free.
To the maximum extent permitted by applicable law, Lunarie and its officers, directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Site or any Product. Our total liability for any claim will not exceed the amount you paid for the Product, giving rise to the claim.
You agree to indemnify and hold harmless Lunarie and its officers, directors, employees, and agents from any claim or demand, including reasonable attorneys’ fees, arising out of your breach of these Terms or your violation of any law or the rights of a third party.
Most concerns can be resolved by contacting us first, and you agree to do so before filing a claim.
Any dispute arising out of or relating to these Terms or your purchase will be resolved by binding individual arbitration in Los Angeles, California, administered by Signature Resolution under its arbitration rules, rather than in court, except that either party may bring a qualifying claim in small-claims court. The Federal Arbitration Act governs this section. You and Lunarie agree that each may bring claims only in an individual capacity and not as a plaintiff or class member in any class or representative proceeding.
30-day opt-out: You may opt out of this arbitration agreement by emailing contact@lunariehome.com within 30 days of first accepting these Terms, stating your name and intent to opt out. Opting out will not affect any other part of these Terms. Nothing in this section waives any non-waivable right, including rights under the California Private Attorneys General Act to the extent applicable.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Subject to the arbitration section above, you and Lunarie consent to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.
We may update these Terms by posting a revised version with a new effective date. Material changes will be reasonably notified. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
These Terms remain in effect while you use the Site. We may suspend or terminate your access if you breach these Terms. Obligations and liabilities incurred before termination survive.
If any provision is found unenforceable, the remaining provisions stay in effect. These Terms, together with the policies incorporated by reference, are the entire agreement between you and us regarding the Site. We may assign these Terms; you may not assign them without our consent. We are not liable for delays or failures caused by events beyond our reasonable control (force majeure). Our failure to enforce a provision is not a waiver. Notices to us may be sent to contact@lunariehome.com.
